PASARA LICENCE

Private Security Agencies are those organizations involved in providing security services including training of security guards. Formation and operation of private security agencies is governed by Private Security Agencies Regulation Act, 2005, in short, called as ‘PSARA.' No private security agency can commence a business or provide security guard without holding a license, the procedure for obtaining the license varies from state to state. The State government in which the security agency is located and providing services has the power to regulate the affairs of the agencies through the controlling authority who can frame rules and regulations for training the guards and supervisors. An application for a license can be made for a district or five districts or a state, the license fee varies depending on the area.

PRE-REQUISITES FOR REGISTRATION OF PASARA LICENSE
  1. Allotment of PAN
  2. Registration with GST
  3. Registration of establishment under Shops & Establishment
  4. Registration under the Contractual labor Act
  5. Provident fund (PF) registration
  6. Employees State Insurance (ESI) registration
PROCESS INVOLVED IN OBTAINING THE LICENSE
  1. Apply for PASARA License before the Controlling Authority of the particular state.
  2. Controlling Authority scrutinizes the application by making required inquires as deemed necessary.
  3. NOC issued from Controlling Authority and Police authorities or rejects application by giving reason.
  4. Within 60 days from the date of making an application the process shall be completed.
DOCUMENTS REQUIRED
  1. The certificate of incorporation of company or LLP
  2. The MOA and AOA of the company or partnership deed or such other agreement document.
  3. Details of the directors
  4. Logo for the security agency
  5. The arms used or to be used details and the licenses obtained by them.
  6. Identify card and such proof of employees.
  7. The uniform pattern or dress code of such deputing security agents
  8. The character and background verification certificate for the employees.
  9. The board resolution or such document showing the decision taken to start a business of PSARA and duly signed by the authorized signatory of the company or organization.
  10. Required affidavits as stated in PSARA.
  11. The tie-up may be in the form of MOU with the security training institute.
  12. Address proof of the place of the business.

COMPLIANCES UNDER PASARA LICENSE
  • All the security agencies has to hire and engage supervisors to supervise the work of the security guards they appoint or depute in the other organizations.
  • Provide necessary training to the security guards appointed.
  • Preferential selection of the people from army, navy or air force with minimum years experience while engaging or recruiting a supervisor.
  • To comply with the criteria of qualifications and disqualifications provided under PASR Act, 2005.
  • To comply with the provisions of the Act in relation to eye sight, health condition and uniform of the security guards appointed.
